22.01.2022 ELDER ABUSE There is an increase in reported incidents of elder abuse. It takes many forms.... Some are subtle like the deprivation of support and assistance with victims becoming lonely, and then their health declines. They become withdrawn, disillusioned and disconnected. Care and compassion are sometimes not enough. The unapproved accessing of funds in bank accounts is increasing. It has never been justifiable to deliberately mismanage other people’s finances for personal benefit especially in the hope that the transactions will not be discovered. The consequences can be a world of pain and embarrassment amongst family and friends. Even more so with the prospect of Police involvement It can be driven by a misplaced sense of entitlement, but usually by simple greed The elderly should be entitled to honesty, respect and compassion. They should be entitled to extra care and support from those close to them, because of their vulnerability. The Supreme Court now has a new weapon, known as the Protective list specifically to deal with such matters. It has wide ranging powers and a willingness to be involved. If you are the victim of elder abuse, you can access recourse.

04.01.2022 WHERE THERE'S A WILL THERE IS A POSSIBLE LEGAL DISPUTE Messy estates are all the rage - from Bob Hawke to Richie Benaud and Neville Wran. Wills need to be carefully drafted but there are no guarantees against a determined plaintiff... Spouses and children are automatically eligible to make a claim on an estate, but anyone can make a claim if they can prove that the deceased had a moral duty to provide for them. If your grandchild has resided with you for a period of time, and you have provided for them during that period (as a parent would), and they have relied on you for their day to day needs, they may make a claim on your estate. Their ‘need’ will be assessed by the Court. Consideration is given to the wealth of the person who is benefi ting (their need) as well as the value of the deceased’s estate. Some people believe the effort they invest in looking after an aged parent should be ‘rewarded’ with a bigger slice of the pie at the time of their parent’s death. Their siblings may not share that view. Leaving equal shares of your estate to all your children may not be what you want to do, but leaving more in your Will to one child opens the door to a claim. Leaving someone who is eligible out of your Will, is only inviting trouble. 02.01.2022 CHANGES TO STAMP DUTY THRESHOLDS FOR FIRST HOME OWNERS OF NEW HOMES As part of the NSW Government’s COVID-19 Recovery Plan, from 1 August 2020 the threshold which provides an exemption for stamp duty for first home owners buying new homes will increase from $650,000 to $800,000. The concession sliding scale will also increase to $1,000,000.... Stamp duty on the purchase of vacant land by first home owners will increase from $350,000 to $400,000 and will phase out at $500,000. The new thresholds will be in place for 12 months and will only apply to contracts dated from 1 August 2020 to 31 July 2021. First home buyers who are purchasing an existing home may still qualify for a stamp duty exemption or concession, however the current thresholds remain the same. Those thresholds are a full exemption for the purchase of a house up to $650,000 and a concessional rate between $650,000 to $800,000. If purchasing vacant land, a full exemption applies for a purchase up to $350,000 and a concessional rate between $350,000 and $450,000. In addition to these stamp duty exemptions or concessions, first home owners buying or building a new home may also qualify for the $10,000 grant under the First Home Owner Grant (New Homes) scheme. If buying a new home, the purchase price must be no more than $600,000. If buying land to build a new home, the total price (including the land and home) must be no more than $750,000.
