17.01.2022 Looking ahead to Unit 4, Outcome 1 of VCE Legal Studies! This fact check by the ABC considers ‘Is it illegal under the constitution for a state to close its borders to other Australians?’ The piece presents a great overview of exceptions to constitutional protections in sections 117 and 92 during the COVID19 crisis. It also features one of Australia’s greatest academics on constitutional law, Cheryl Saunders. She’s the author of constitutional law text books used at law sch...ools across Australia. I was fortunate to have her as a professor at Melbourne Law School! Cheryl Saunders from the University of Melbourne Law School said neither section 117 nor section 92 "contains an absolute prohibition" on state border closures. "Both are read by reference to purpose," Professor Saunders said. "They have never been tested in circumstances like the present, obviously, but as long as the restrictions are limited to the life of the emergency, tailored to protecting public health, and do not single out interstateness without good reason, I would expect them to be able to operate consistently with the constitution." https://mobile.abc.net.au//fact-check-state-bord/12164440
