22.01.2022 The National Redress Scheme is in full swing with many applicants receiving offers of financial redress in respect of institutional sexual abuse. The Redress Scheme offers financial compensation, counselling and in some circumstances a direct response from the Institution involved. 22.01.2022 Private Sessions Now Closed. The Royal Commission into Institutional Responses to Child Sexual Abuse has now closed applications for private sessions. This is so that those currently registered for private sessions can be heard before the Royal Commission finishes in December 2017. The Royal Commission received an overwhelming response from survivors of child sexual abuse, and has put many institutions under much needed scrutiny. Those whose still wish to tell their story can give a written account to the Royal Commission and this will be provided to a Commissioner.
22.01.2022 CTP Scheme for Accidents Occurring After 1 December 2017 There have been some massive changes made to the current CTP scheme covering motorists injured in motor vehicle accidents from 1 December 2017. New time limits and entitlements apply, so it is worth getting legal advice quickly if you are unfortunate enough to be involved in an accident. 21.01.2022 Royal Commission happenings. The Royal Commission are currently holding a public hearing into the response of the Catholic Church to allegations of child sexual abuse by former Priest, John Joseph Farrell. Farrell was convicted of 63 child sex offences relating to 12 victims in May this year. He was sentenced to a minium gaol term of 18 years.... I previously acted on behalf of one of Farrells victims in a civil claim against the Catholic Church and attended Court for the sentencing in May. It was a momentous occasion for Farrells victims, as justice was a long time coming. The sentence did actually seem to reflect the gravity of the offences. The Royal Commission will now consider whether the response of the Catholic Church was adequate in relation to the allegations made against Farrell. The first complaint appears to have been made as early as 1984, when Farrell was an Assistant parish Priest in Moree. He was moved to different parishes, and was ultimately laicised in 2005. 15.01.2022 George Pell has been sucessful in his High Court Appeal and his convictions have been quashed. The Court found that the jury acting rationally should have entertained a doubt about his guilt (particuarly in relation to the issue of whether he had the opportunity to commit the offences). Last week the ABC aired a three part series "Revelation" which has some very interesting interviews with convicted Priests and the cover up by the Catholic Church, including info about Pell. It is certainly worth watching.
14.01.2022 Conviction rates in child sex offences have fallen, rather increased since the Royal Commission was established in 2012. Lets hope the RC results in some proper reforms. 13.01.2022 Update on the proposed CTP changes: There has been some back and forth about this from the NSW government. They intially indicated they were re-thinking the proposals and the reforms were to be delayed, however this didnt last long. It appears that CTP reform is back on the agenda for the Baird government. The Australia Lawyers Alliance intend to launch a large scale public campaign in the new year, so we will stay tuned for that.

10.01.2022 An end to the Ellis Defence in Victoria. Great news for John Ellis, and for survivors of sexual abuse. The Ellis Defence meant that legally the Catholic Church could not be sued, as its assets were held in a trust. The Church will now have to nominate an entity capable of being sued.

09.01.2022 This is a super interesting UK case on vicarious liability. 126 Claimants successfully sued Barclays Bank for sexual assaults occasioned by a doctor engaged by the bank to carry out medical examinations at the start (and during) their employment. The bank has leave to appeal which will be heard in late November.

05.01.2022 When this kind of disgraceful rubbish comes from the top, we know the Catholic Church still don’t get it. They have chosen to continue to close ranks and protect their own. Sexual abuse on a child has a profoundly destructive impact upon them. The victim in Pell’s case went through years of harrowing legal processes and Pell was acquitted, not because he was innocent, but because the prosecution did not have enough evidence to overcome the burden of proof required. They only had one witness who was a child at the time, so it is not surprising. But at the end of the day the surviving victim spoke his truth - he must also know that Pell knows the truth.

A blameless accident is exactly as it sounds, that is, an accident where no one is at fault. 04.01.2022 We are about to experience some major changes to the current CTP scheme, thanks to the Motor Accidents Injuries Bill 2017, which is likely to be passed in December this year. Supposedly the new scheme will keep premiums to around $528. I am across the legislation and will provide a summary in my blog in the near future. Unfortunately there are no rainbows and definitely no unicorns.
