01.01.2022 On 7 September 2017 the government released its Housing Tax Integrity Bill into Parliament to give effect to its Budget announcement regarding investors in residential property and was passed through the senate on 15th November with the Bill confirmed as legislation. Essentially the new rules apply to plant and equipment installed in residential rental properties at the time the premises were acquired. The Bill confirms that the rules will apply to depreciable assets installe...d in existing residential properties at the time the premises are acquired for rental purposes. Although the new rules affect second-hand residential properties, the good news is that there are still substantial dollars to be claimed. Capital works deductions for new and second-hand properties which make upwards of 85% of claims are unaffected regardless of when the property was purchased. Purchasers of brand new residential and substantially renovated properties, commercial real estate or add new plant and equipment assets to a second-hand residential properties can still claim substantial depreciation deductions.
