24.01.2022 Unfortunately, married and de facto couples separate. It can be an emotionally charged experience; we totally get that! (who invited this guy, right?!?) One of the best things someone can do for themselves is to seek legal advice about his or her options (be it property or children) as early as possible following separation. Being provided with sound and friendly legal advice can also help make a difficult time less stressful and assist you to avoid unwanted costs and/or surprises months, or even years later!

09.01.2022 One of the challenges often faced by a small to medium sized business is the ability to negotiate a transaction with a larger business. Often the power balance is in favour of the larger business. This challenge is often amplified because the larger business may impose its terms and conditions upon the other party without any argument or scope for meaningful and fair negotiation. One of the options open in such a situation is to obtain affordable legal advice prior to enter...ing into an agreement for a frank, an honest and a worthwhile opinion on any immediate or future risks to a business. Obtaining advice on a proactive basis prior to a transaction occurring can potentially save thousands of dollars once the parties have entered into an agreement. We would much prefer to help at the beginning to provide a business with negotiating muscle before any potential future disputes arise!

08.01.2022 One of the hardest things for a loving mother or father to cope with is to suddenly not be able to spend time with their children after separation (yes ... even when they are watching ABC2 on repeat or their toast is not cut just right!). One of the considerations the Court must take into account is that it is in the child's best interest to have a meaningful relationship with _both_ parents (& ). This consideration is external to any other factors (e.g. payment of ch...ild support). 05.01.2022 Where corporate law and family law meet? *drum roll* Sometimes when a family own a business it is setup in a corporate structure, typically with each spouse having 50% of the shares and both being appointed as directors #soundedlikeagoodideaatthetime. The issue that may arise is where one spouse (or both) start to or do act in a way contrary to the best interests of the company (often due to marital or relationship problems), it may cause him or her to unwittingly breach h...is or her director's duties. Not cool. In such situations it is wise to seek legal advice as to what action to (and not to!!) take to ensure you discharge those directors duties and to ensure the asset is preserved for any future division of property.

Well the simple answer is this.. when it is not a contract. #captainobvious In certain circumstances a contract or transactions may be set aside; for example, where parties to the alleged contract have a recognised relationship with each other (e.g. parent and child) and the stronger party is presumed to have influenced the weaker party or where one party is at a special disadvantage and other party exploits it or where the transaction (or parts of it) are illegal. So broadly, in those circumstances a contract may be able to be set aside. If so, there may be no contract at all.

However, whilst these agreements can be useful, they must be prepared very carefully and in such a way as to address all financial dealings during the relationship and/or marriage and eventualities thereafter.
