24.01.2022 What’s Brewing? DEBT COLLECTION The Australian Competition and Consumer Commission (ACCC) and the Australian Securities and Investments Commission (ASIC) have enhanced their guidance to Creditors and Collectors involved in debt collection activities.... Reflecting recent legislative changes and court outcomes, the updated guideline aligns with the introduction of Australian Consumer Law in 2011, the National Consumer Credit Protection Act 2009, and new Privacy laws. Your rights as a debtor and the obligations of debt collectors have been clarified, to ensure that collection activity is undertaken in a way that is appropriate and consistent with the Commonwealth consumer protection laws administered by ASIC and the ACCC. Initially published in 2005, the ‘Debt collection guideline: for collectors and creditors’ has been updated to cover: - appropriate contact methods and timing for collection of funds from a debtor - reasonable and flexible interaction between collectors and debtors - social media platforms and telephone auto dialers, and the risks associated with the use of these new technologies. While Australian Consumer Law (ACL) is managed by the States and Territories, it is supported by the Australian Securities and Investments Commission Act 2001 (ASIC Act), administered at the Commonwealth level to ensure appropriate, fair, measured and realistic debt collection methods. ASIC and the ACCC encourage all businesses to adhere to the new provisions and incorporate them into their arrangements with agents and assignees, advising that breaches of the new guideline attract enforcement action and significant penalties. Do you have any experiences you’d like to share or query regarding collection of debt in your financial dealings?

09.01.2022 What's Brewing? LONG DAY CARE Replacing the prior Federal Government’s ‘Early Years Quality Fund’, a new Program has been introduced by the Department of Education, entitled the 'Long Day Care Professional Development Programme' (LDCPDP).... To-date, of the registered Children’s Long Day-Care services who meet eligibility requirements, more than half have applied for the LDCPDP, with many more expected prior to applications closing this Friday, 13th June. Amounts which eligible services can claim to support the professional development of their staff are based on several factors, including staff qualification in Early Childhood Years Education, and whether the service is located regionally or remotely. A significant change to eligibility for this replacement program is the absence of a requirement for Childcare services to have Enterprise Agreements in place. What are your experiences of the quality of care for your children or grandchildren, in light of the daily cost of Childcare services, or of the salaries paid to Childcare workers?

06.01.2022 What's Brewing? PALLIATIVE CARE There are many important issues to consider when contemplating our own inevitable mortality. These include advance plans for the treatment you would elect in the event you may require Palliative Care.... The Federal Government’s Department of Health has announced the provision of additional funding to improve Palliative care services and training for health professionals. This initiative will supplement existing funding to support education and training opportunities in Palliative Care, and has been announced during National Palliative Care Week, which runs until Saturday. State and Territory Governments are responsible for delivering these services over a 3 year program, with no changes made to the provisions for palliative care medicines or consultations under existing Pharmaceutical or Medicare schemes. Only a minority of Australians have seriously considered their needs in this area. We'd love to hear about any related experiences or situations you may have questions about - ideally by private email to [email protected], but feel free to post general, relevant comments or queries here as well.
