25.01.2022 On Monday, The Migration Place officially partnered with the Australian Chinese Workers Association to facilitate a summer program with the Southwest University of Political Science and Law in Chongqing. As a part of this summer program, The Migration Place and Irish Bentley Lawyers will provide final year law students with an opportunity to live and work in Australia, and gain valuable insight into the Australian legal system while we host them at our firm in Brisbane City. We are looking forward to building this relationship with the Australian Chinese Workers Association and Southwest University, and we thank them for such an exciting opportunity.



24.01.2022 DOHA Heads in a New Direction The Department of Home Affairs has, as of today, revoked the previously-existing Direction 65 that provisioned for visa cancellation under s501 of the Migration Act and revocation of mandatory cancellation and replaced it with Direction 79. This change commences on 28 February, 2019, and separates crimes of a violent nature against women or children into new subclauses, added to the text of the prior Direction 65. With this new Direction, vio...lent crimes against women and/or children, regardless of the sentence, will be considered in the most serious manner. This new Direction supports the Australian Governments low tolerance for family violence, and further facilitates the Australian communitys intolerance for and strong stance against the same. What this means for any future applicants is that, should you have been convicted of a violent offence against a woman or child, it will be more difficult for you to have an Australian visa granted. 23.01.2022 This week, The Migration Place has been represented at the Immigration Law Conference by solicitor Dan Jebsen. The Law Councils CPD Immigration Law Conference is an annual event, taking place in a different location each year. This years conference is being held in Canberra, and will examine how contemporary values and beliefs interact with the operation of Immigration law. 22.01.2022 Changing VETASSESS Employment and Training Requirements VETASSESS has announced that its application portal will be closed from Wednesday 27th February until Friday 1st March to allow changes to be made to coincide with Trades Recognition Australia (TRA) announcing changes to the Trade Skills Assessment program for TSS (Temporary Skill Shortage), OSAP (Offshore Skills Assessment Program), and TRS (Trades Recognition Service). For Pathway 1 assessments, the amount of verifiabl...e employment evidence an applicant must submit for their nominated occupation has been changed: - Licensed trade with no formal training six years work experience - Licensed trade with formal training four years work experience - Non-licensed trade with no formal training five years work experience - Non-licensed trade with formal training three years work experience All applicants must also have completed at least 12 months of employment in their nominated occupation in the three years prior to lodging their application. From the 1st March, VETASSESS has also ruled that new applications must be accompanied by ALL of the documentary evidence required for Stage 1. Additionally, from the 1st March, a new fee schedule will apply to the TSS, OSAP and TRS programs, with all payment to be processed directly through the TRA website. 21.01.2022 Both the Regional Sponsored Migration Scheme (subclass 187), and the Skilled Regional (Provisional) visa (subclass 489) will close from 16 November 2019. The Regional Sponsored Migration Scheme (Subclass 187) will remain open for applicants who: - on 20 March 2019, held a Temporary Skill Shortage (Subclass 482) visa in the Medium-term stream, or was an applicant for a Temporary Skill Shortage (Subclass 482) visa in the Medium-term stream that was subsequently granted..., or - on 18 April 2017 held a Temporary Work (Skilled) (Subclass 457) visa; or was an applicant for a Temporary Work (Skilled) (Subclass 457) visa that was subsequently granted. RSMS nominations lodged before 16 November 2019, will be taken to have been withdrawn on 16 November 2019 if: - the nomination has not been approved or refused before 16 November, and - the nominee is not transitional 457 or 482 employee, and - the nominee has not lodged 187 visa application before 16 November The timeline for the closure of the Skilled Regional (Provisional) visa (subclass 489) has been announced, with the 10th of September 2019 being the last day for expressions of interest to be lodged, and for States and Territories to nominate and invite applicants. Those who have received a nomination or invitation then have until midnight the 15th of November 2019 to lodge their application before the subclass closes completely. 04.01.2022 New Five-Year Parent Visa Announced Minister Coleman, Minister for Immigration, Citizenship and Multicultural Affairs, recently announced the introduction of the new five-year Sponsored Parent Visa, the Subclass 870, with applications opening on 17 April 2019. Parents on this visa will be able to stay in Australia for up to five years at a time without having to depart and the Department of Home Affairs has announced that up to 15,000 of these visas will be granted per year,... although this visa is still subject to the introduction of potential future regulations. This visa attracts the application cost of $5000.00 for its three-year duration variant, and $10,000.000 for its five-year duration variant. The application cost is to be payable in two instalments, with one payment to be made at the time of application and the remainder to be paid prior to visa grant. Other notable features of the visa are the fact that no Balance of Family test or no work condition will be applied. Applicants must prove that they have health insurance and provide evidence of access to funds, however. If you are a migrant to Australia and you want to bring your parents over to live with you, this could be the right visa solution for you. Before your current temporary visa expires, you are required to lodge another valid visa application in order to stay in Australia lawfully. However, you will need to meet the requirements in order to secure a visa grant. ... The Australian government has introduced a new stream to the existing Temporary Activity Visa (subclass 408) to provide certain temporary residents with options to stay in Australia. The stream is provided for an applicant who is: a. in Australia; and b. unable to depart Australia as a result of the VOID-19 pandemic; and c. either (i) the temporary visa is going to expire in 28 days or less; or (ii) the temporary visa has ceased no more than 28 days before the subclass 408 visa is lodged; and d. unable to make a valid application or meet the visa requirements for your current or previous visa; or other temporary visa other than the subclass 408 visa. e. There is no visa application charge for applications submitted under this pathway.
