10.01.2022 ON THE 35TH DAY ‘TIL CHRISTMAS MY (EX) TRUE LOVE GAVE TO ME.AN APPLICATION FOR CHRISTMAS TIME WITH OUR CHILDREN FAMILY COURT FILING DEADLING FOR CHRISTMAS PARENTING APPLICATIONS: 13 NOVEMBER 2020 Christmas will be here before we know it, and many separated parents can find themselves in the difficult position where there are no agreed agreements for the children over the Christmas period. ... This can pose all sorts of challenges for separated parents, particularly in the first holiday after the separation. These circumstances are often even harder for children. It is always preferable for parents to find a way to work together and reach an agreement regarding the arrangements for their children. The Family Court also requires parties to try to negotiate before filing an application at the Family Court. Here are some examples of different arrangements that we have come across in our work, that might work for your family: 1. Children staying with one parent from Christmas Eve until Christmas morning, and with the other parent, from Christmas morning until Boxing Day. 2. Children staying with one parent for the whole week during Christmas, and with the other parent, either the week before or the week after Christmas. 3. Children staying with one parent for Christmas Day, but spending a few hours that day with the other parent. 4. Children spending the entire Christmas period with one parent and this arrangement being alternated between parents each year. If all efforts have been exhausted, parties sometimes need to consider seeking the Court’s intervention. In those cases, it is recommended parties seek experienced advice from a Family Law solicitor. Strict time limits apply to Family Law applications seeking specific Orders for time with children over the Christmas period. The Family Law Rules provide that these applications must be filed no later than close of Registry on the second Friday each November, which this year will occur on Friday 13 November 2020. 04.01.2022 On 31 March 2020 the Western Australian Government declared a prohibition on regional travel, to limit the spread of COVID-19. Many people are now left wondering what their obligations are to facilitate time between their children and the other parent, when that would require regional travel. It is important to understand that there are exceptions under the Directions made by the Government, that provide that entry into another region is prohibited, except to the extent t...hat: 1. It is necessary to return to the person’s principal place of residence; 2. It is necessary for the purpose of a person being primary carer for a family member or for someone for whom the person has primary caring responsibility; 3. It is necessary in order to escape from the threat of physical or psychological harm or some other emergency; 4. It is necessary for the person to do so for the purpose of fulfilling their obligations under a parenting plan, parenting order of a Court or other parenting arrangement. If your current care arrangements are not formalised, parents should consider entering in to a Parenting Plan or having parenting Orders made by the Family Court, to ensure that there is an understanding about what the ongoing arrangements for the children will be, and to avoid any potential difficulties with regional travel in WA. It includes features such as a calendar for family plans, a message board which does not allow for the deletion or editing of any messages, a journal to record observations and share memories with your co-parent, expense log to track parenting expenses and an info bank to include all your family’s important information such as medical records.
