18.01.2022 Common Assault | Coffs Harbour Local Court | 28 July 2020 Our client had a verbal argument with her partner. During the argument, she ripped her partners t-shirt. The verbal argument continued. She called the Police. When the Police arrived, she informed the Police of the argument and that she ripped her partners shirt. Unfortunately as our client had provided a statement to the Police before obtaining legal advice, she had admitted to the offence.... The maximum penalty for Common Assault is 2 years imprisonment and/or a $5,500 fine. We entered a plea of guilty at the first opportunity and made strong submissions on behalf of our client. Principal Solicitor, Nicole Turnbull, drew the courts attention to the fact that this was a first offence for our client, that it was out of character, that the parties were still in a relationship, that our client had the support of her partner and that it was unlikely she would reoffend again. On this basis, we submitted it was appropriate to deal with the matter without proceeding to conviction. The court agreed with our submissions and dealt with the matter by way of a 12 month Conditional Release Order, with no conviction recorded. Our client was very pleased with this outcome. It meant she avoided a conviction and a fine. It is very important that your matter is prepared thoroughly and presented professionally, even if you are pleading guilty.
