25.01.2022 Just to clear the air on this subject



24.01.2022 OK this year I am putting out an early Christmas message - Why? Because the Christmas parties and celebrations are starting to happen and believe it or not I often hear from the same people year after year telling me they keep on getting hassled out by the cops (especially over the festive season). So my solution to this is simple- if you do not want to be hassled by the cops then stop doing stupid stuff. Police tend to get called to your place if there is a domestic going o...n so if you have a criminal history showing that you seem to get busted during festive moments and upon reflection you realise that this is when you consume alcohol or drugs - then - lay of the alcohol and/or drugs this season. Unless you make change to your tradition of overdoing it then history will repeat itself. If you want to see me then please feel free to pick up the phone or send me a message - you do not have to be charged with a criminal offence to do so. Try doing something different this season. Instead of showing members of the local community that you are a shocking drunk or a shocker when taking your favourite substance just have one season away from it and you will be surprised at the difference. I know your partners and friends will be ! Be safe folks and remember do not drink drive the coming season. Regards Vince Boss

17.01.2022 What should your Legal Representation cost you? Never be afraid to ask why your legal fees cost so much. There appears to be some significant differences in cost for the same provision of legal services that one has to wonder - am I getting value for my $$$. I will give you a classic example - I recently saw a Cost Agreement from a law firm to one of their client's quoting them $2,500.00 for a basic plea in the Local Court. on top of this the firm also had an initial cons...ultation fee of $295.00. So that is $2795.00. Now I raise this point because I am aware that many firms for the same type of plea charge between $700.00 - $900.00 . That is correct - a difference of about $2000.00 for the same thing. So if you don't think you are getting value for your dollar then ask "exactly what am I paying for?" Food for thought.

16.01.2022 BE WARNED Many would be aware that the Nats MP Troy Grant (Minister for Police) was given a ticket for using his Mobile Phone whilst stationary. He took a photo... of a sheep that was sitting in the boot of the car in front of him. Many times I see people pulled over on the side of the road talking on their phones. You may think you are doing the right thing by pulling off to the side of the road however the law says different. There are two things you need to consider: 1) What is a road related area; and, 2) what is being in control of your vehicle. 13 What is a road-related area (1) A "road-related area" is any of the following: (a) an area that divides a road, (b) a footpath or nature strip adjacent to a road, (c) an area that is not a road and that is open to the public and designated for use by cyclists or animals, (d) an area that is not a road and that is open to or used by the public for driving, riding or parking vehicles. Note: "Vehicle" is defined in rule 15. (2) However, unless the contrary intention appears, a reference in the Australian Road Rules (except in this Division) to a "road-related area" includes a reference to: (a) an area so far as the area is declared, under another law of this jurisdiction, to be a road-related area for the Australian Road Rules , or (b) any shoulder of a road, or (c) any other area that is a footpath or nature strip as defined in the dictionary, but does not include a reference to an area so far as the area is declared, under another law of this jurisdiction, not to be a road-related area for the Australian Road Rules . 2) Essentially being in control of your vehicle can be made out by sitting there with your motor running. So if you are going to use your phone and you are in an area as defined above then you need to have your engine turned off otherwise you will receive the same ticket as our Minister for Police. So if you have to pull over to make a call remember - turn your motor off. If you are on a beach open to 4wds then the same applies. Same with car parks, caravan parks, grass verges etc etc. REMEMBER: Pulling off to the side of the road is just not good enough

12.01.2022 It has been some time since I put up a post in this page. There have been a lot of obstacles for many throughout the last 12 months. Some obstacles are avoidable and some are not. As many of you have seen I have posted on my private page my level of disgust and distain for the flagrant disregard politicians have shown in the erosion of people's rights whilst letting big business through with a different set of rules. The border issues especially on the NSW/QLD border have b...een handled in such a manner that compassion, empathy, integrity and humanity have been lost whilst the QLD Government lets the money makers through. As from this point in time I would like it to be known that if you receive a fine or court attendance notice in NSW for Covid breaches, and the breaches were conducted due to personal family stressors then I will represent you for nothing (Pro-bono) . Clearly I am not permitted to cross the border into QLD at this point in time to act in the QLD courts, so I ask if there are any Solicitors in QLD prepared to do the same then please let me know so I can refer people to you . I also ask for any Solicitors on the NSW/Vic borders. It is clear that we as a people are experiencing stressful periods of lockdown, isolation, financial crisis and separation from loved ones. These matters are only the tip of the iceberg with consequences such as depression, mental health issues, suicide and family breakdown following on. At a time when many in our communities need to be shown support, respect and empathy - they are shown anything but. So if you have legal issues arising out of this shambles of Gov't protocols then please feel free to contact me. If I can not assist you then I will find someone who will.



09.01.2022 If you think we have it bad over here then read this. Always remember this article if you ever hear of Governments in this country talking about Privatising goals (of which they already are) the creation of prison industries combined with privatisation can only mean one thing = Legalised Slavery.

07.01.2022 THINK BEFORE YOU DRINK! Over the Christmas period there have been amendments to the legislation pertaining to drink driving. If you are charged with a mid range PCA offence after 3 December 2018 then it will be an automatic Interlock order made and you will have to have an interlock device fitted to your car and will be on an interlock licence for a considerable period of time (discretion of the court) . Even if it is your first offence. As such you will not be able to drive ...any vehicle without a device fitted. This has far reaching affects for anyone who may have to drive another vehicle for work. Despite having your licence - you will not be able to maintain your current employment if driving is a requirement. If you decide you do not want to an interlock order and apply to the court for an interlock exemption then you will be automatically disqualified for a period of 5 years. So please think before you drink. 5 years off the tack is a lot to pay for a drink to many. (.08)

04.01.2022 For those of you out there who have lengthy periods of disqualification from holding a drivers licence please note there have been changes in the Legislation that are effective this week. If you have had two years of not offending then please contact me. There are now avenues available through the Court system to make applications to have the remainder of your disqualification periods removed. Please note in some circumstances you will need to have not committed any offences for a four years period. Either way - the opportunity is now here.
