25.01.2022 Media release: Frankston FC VFL licence reinstated for 2018 VFL season 4th August, 2017... The Frankston Football Club Board of Management and Staff are delighted to announce that AFL Victoria have formally advised the club that they have reinstated our licence to compete in the VFL in the 2018 season. Great news for Frankston



23.01.2022 Even though we are in lockdown and we can't see clients face to face at the office, Willerby's staff are still working and we are still able to assist with your legal needs. 18.01.2022 Willerbys Solicitors are still able to handle all of your business during Covid restrictions. We are seeing clients when required but face-to-face contacts are limited. 17.01.2022 The road works at the front of our office will be taking place this Thursday 21/07/16 which means there will be no vehicle entry on Thursday or Friday this week. Foot traffic can enter. The driveway will re-open on Monday.



17.01.2022 The High Court decision has been made about the Pre-Nuptial Agreement made between a wealthy Australian businessman and a "mail order" Eastern European bride (refer below). the Court found that the Agreement was not enforceable because the bride was pressured into signing it shortly before the wedding and was told if she didnt sign it, the wedding would be called off. The Court found that the husbands approach was unconscionable and that he exerted undue influence on the ...wife to sign. The matter will now go back to Court to determine what a fair outcome is for the wife. The lesson here is that parties seeking to enter into a Pre-Nuptial Agreement must discuss the arrangements well ahead of the wedding and have plenty of opportunity to obtain independent advice and that there needs to be actual informed agreement from both parties. Also it appears that the Agreement must be considered to be fair and provide for reasonable financial support for each of the parties in the event of separation. See more

16.01.2022 PHONE PROBLEMS Sorry to anyone who has been trying to phone us in the last couple of days. It seems our main phone no 9781 2899 was hijacked by one of these cold calling start up Telcos without our knowledge or authorisation. We have now got our line back but still waiting for the line hunt to be re-established so you might get an engaged signal or no answer. If so please call an alternate number 9781 2124, 9781 2436, 9781 2219. Hopefully the line hunt will be restored today.

If you see our old address (2/474 Nepean Hwy) listed anywhere would you please let us know. We have tried to change all records but it is difficult to cover everything on the web.

15.01.2022 CORONAVIRUS PROCEDURES In order to assist with the limitation of possible transmission of Coronavirus, Willerbys door will be locked from Monday 23 March 2020. Face to face appointments must be pre-arranged and will be limited. We will not accept "walk in" face to face interactions. For document drop offs there is a mail slot by the front door. We can continue to communicate and offer assistance via phone and email and zoom conferences can be arranged if required. We know you will understand that these precautions are for the benefit of our staff and our clients as we all learn how to deal with these unusual times. We request that you do not attend our offices without pre-approved arrangements and instead rely on electronic communications in your dealings with Willerbys.

14.01.2022 Medical Treatment Laws New laws in relation to medical treatment directives and medical treatment decision making came into effect on 01/03/18. Under the new laws, Victorians are able to create a legally binding advance care directive that allows them to: Make an instructional directive (which will provide specific directives about treatment a person consents to or refuses). Make a values directive (which will describe a persons views and values to be taken into account ...by doctors). Appoint a medical treatment decision maker (who will make decisions on behalf of a person when they no longer have decision making capacity). If a person is unable to make their own medical treatment decisions then the following person will be entitled to make medical decisions for them but must take into account any directives given by the patient:- 1. an appointed medical treatment decision maker; 2. a guardian appointed by VCAT; 3. the first of the following with a close and continuing relationship with the person: the spouse or domestic partner; the primary carer of the person; the oldest adult child of the person then second, third etc; the oldest parent of the person; the oldest adult sibling of the person. If you are happy with the sequence of authorised persons under category 3 above (and there is no VCAT order in place) then you do not need to appoint a medical decision maker. If you want someone else, other than the priority sequence in category 3 then you will need to make an official appointment of medical decision maker. The old Medical Treatment Power of Attorney no longer applies but if a Medical Treatment Power of Attorney was made before 01/03/18 then it will operate as if it is an appointment of a medical decision maker. 14.01.2022 NEW POWERS OF ATTORNEY The Powers of Attorney Act 2014 (the Act) commenced on 1 September 2015. A copy of the Act can be found at legislation.vic.gov.au. The purposes of the Act are to: clarify and consolidate Victorias enduring powers of attorney laws... create the role of supportive attorney improve the protections against abuse of enduring powers of attorney. Powers of Attorney made under existing legislation will remain valid under the new Act. The Act does not affect enduring powers of attorney (medical treatment), which will continue to be regulated separately under the Medical Treatment Act 1988.

14.01.2022 Road works: The Council will shortly be carrying out road works in front of our office including replacing our cross-over. We have plenty of on-site parking for our customers but while the road works are in progress we may not have vehicle access to our office. During the works customers can park at the shopping centre or you may be able to find parking in Nepean Highway. sorry for any inconvenience but once the works are completed we should have a better crossover and hopefully no more puddles on the roadway.

08.01.2022 A High Court decision is expected soon in relation to Pre-Nuptial Financial Agreement signed shortly before a wedding. It has long been believed by many lawyers that the process of getting a party to sign a "Pre-Nuptial" Agreement shortly before a wedding is likely to lead to the allegation that the agreement was signed under duress and should be set aside. The case before the High Court involves a foreign national who came to Australia to marry a wealthy Australian and was t...hen told if she didnt sign a Pre-Nuptial Financial Agreement 3 days before the wedding that the wedding would be cancelled. A Financial Agreement can be entered into between partners (married or defacto) before, during or after the relationship. It is intended to be binding. However one ground upon which a Financial Agreement can be set aside is where "a party to the agreement engaged in conduct that was, in all the circumstances, unconscionable". The High Court has heard argument about this case and will deliver its decision in due course. (That may be weeks or months). Stay tuned. See more

05.01.2022 Willerbys is on the move. We have now acquired big new offices at 408 Nepean Highway Frankston (north of the BP Service Station), We will have plenty of space and we will have CAR PARKING for staff and clients. We will be moving in around May 2015. Keep posted.

02.01.2022 NEW POWERS OF ATTORNEY Has anything really changed? Probably not for most people. There are more stringent requirements for signing to try to confirm that a person has capacity. There are also more options available in terms of conditions and limitations but in reality, in most cases, the new documents will be used in the same manner as previous Powers of Attorney. The key here is that there is now more choice and it is worth discussing your options with your lawyer.
