25.01.2022 Online retailer Kogan has been pinged by the ACCC for misleading representations around sale prices in 2018. The ACCC sued and alleged that Kogan: - inflated its prices prior to the sale; - discounted prices for those goods shortly after the sale ended. The Court found the sale price discounts advertised by Kogan were not genuine discounts, and thus consumers were misled into thinking they scored a bargain by purchasing the products. (Penalties for breach have yet to be det...ermined.) #TIP: If youre having a sale, ensure that the sale price is a genuine discount off the usual retail price. 17.01.2022 To discourage panic-buying many retailers (including the major supermarket chains) are now modifying or suspending "Change of Mind" refund policies for selected goods. Customers who have purchased excess amounts of some items may find themselves unable to return the goods to the place of purchase. Generally, offering a "Change of Mind" refund is at the discretion of the retailer and is not mandatory under the Australian Consumer Law (ACL).... However, consumers and businesses should be aware that the statutory guarantees provided under the ACL remain enforceable for consumer products and services. These statutory guarantees cover circumstances where goods are faulty or defective, unfit for purpose, do not perform as advertised, or do not match the description. For businesses, its important to seek advice before setting or changing refund and return policies to ensure they comply with the ACL. The changes include: - raising the threshold for Bankruptcy Notices and Creditors Statutory Demands up to $20k; - extending the deadline to respond to a Bankruptcy Notice or Creditors Statutory Demand to 6 months; - temporary protection of company directors from insolvent trading liability.... While debtors have gained a small reprieve from insolvency proceedings, suppliers need to be mindful that it is likely to be more difficult to enforce against debtors in the current circumstances. Suppliers should consider implementing prepayment/deposit policies or PPSR security arrangements where possible to mitigate against payment risk and to appropriately secure unpaid or leased goods. The dispute centres around the sale of Krafts peanut butter business to Bega, and which company has the right to use the distinctive yellow packaging (known as get-up or trade dress).
