25.01.2022 Underquoting properties for sale is now a thing of the past, with the new laws introduced by the Victorian Government in May 2017. Real Estate Agents are prohibited from marketing a property at a price which the property is unlikely to sell. For example, if the sellers asking price is $550,000 the property cannot be marketed at $500,000. 21.01.2022 Have you been served with an Application and Summons for an Intervention Order? Are your children listed on the Application? The Application should not be ignored. Take note of the future Court date printed on the top right hand corner of the Application. It is strongly recommended you attend Court regardless of your work/social/family commitments. Do not ignore the piece of paper because its full of lies and you simply dont have time to entertain it. If your children are listed on the Application you should seek sound legal advice as it may possibly affect the time you spend with your children, including the imposition of certain restrictions, depending on the nature of the allegations.

21.01.2022 Over the past week, Federal and State Courts have implemented new policies and procedures in light of the Coronavirus disease (COVID-19). We will provide our followers with a detailed update on Friday 20 March 2020 of the significant changes. This will be done in one post to avoid information dumping, that may create confusion and unnecessary anxiety for those who have matters currently before the Courts, as the policies are reviewed and changed from time to time.

21.01.2022 If you are living in Victoria and are renting, here is what you need to know: 1. There is a 6 months moratorium on evictions. This means if tenants cant pay their rent, they cant be evicted. 2. $420million has been allocated towards land tax relief for landlords. This will include a 25 per cent discount and deferral of payments to March 2021.... 3. Additional land tax relief will be offered to landlords if they are involved in a mediation process with tenants. This means if a tenant is experiencing significant hardship and broker a deal with their landlord through CAV or Small Business Commissioner. 4. Tenants experiencing financial hardship can apply to CAV or Small Business Commissioner to broker a deal to have their rent reduced. If the parties negotiate in good faith and the landlord agrees to reduce the rent BUT the tenant continues to suffer from financial stress (where the rent represents more than 30 per cent of your income) the State government has allocated $80million in rent assistance. To be eligible tenants would have to have gone through the negotiation processs, earn less than $100k per year and have less than $5k in savings. Up to $2000 will be made available to them to assist with their rental repayments. This money will be paid directly to the landlord and applies to residential tenants only.



17.01.2022 People diagnosed with dementia or Alzheimers disease, in most instances, no longer have the legal capacity to sign legal documents, including a Power of Attorney or a Will. Once a person is deemed not to have legal capacity the guardian, or next of kin, are required to make an application to VCAT for the appointment of a guardian or administrator. This will allow the guardian to make decisions in relation to the day-to-day welfare of their loved ones.

Our simple answer each case is unique. No case is the same. Property distribution is not as black or white as many people perceive it to be. The Victorian Government has introduced new laws that will prohibit a retailer from selling or providing light weight single plastic bags to consumers/customers as of 1 November 2019. Penalties ranges between 60 penalty units for a natural person and up to 300 penalty units for a body corporate.

13.01.2022 Legal Update: As you are well aware the laws are about to change with respect to mobile usage while driving. As of 25 November 2013 if youre caught illegally using your mobile while driving you will receive a $433 fine and a loss of four demerit points. Also the total ban on mobile phone use will be extending from P1 drivers on red P-Plates to P2 drivers on green P-Plates.

05.01.2022 Priority Notices will be introduced in Victoria in December 2016. It is a notification of intended dealings with land and is lodged at Land Victoria. Once lodged it will temporarily prevent any registrations of any other dealings except for caveats, warrants and land tax charges. It has a lifespan of 60 days which will then lapse. They must be electronically filed, even if you file in hard copy. It will protect the interests of those intending to have dealings with the land before a transaction is lodged, alert interested parties who search the register and assist in fraud prevention. 03.01.2022 Significant changes have been made, over the past week, to the way in which the Family Court of Australia, and the Federal Circuit Court of Australia conduct all future hearings. The table below provides a breakdown of how the new measures will affect you. The the most significant change is a reduction to face-to-face Court time, with hearings being conducted via teleconference, if deemed suitable by the Court.

01.01.2022 Notice from the State Revenue Office for LMCTs "Licensed motor car traders (LMCTs) have until Sunday 30 September 2018 to voluntarily disclose any motor vehicles they have incorrectly obtained a duty exemption on over the last five years. By voluntarily disclosing any incorrectly obtained duty exemptions by Sunday 30 September 2018, LCMTs will reduce the amount of penalty tax payable to 5 per cent plus interest on any outstanding duty, from up to 90 per cent that would be pa...yable without a voluntary disclosure. Under the Duties Act 2000, the exemption from duty is only on demonstrator vehicles used exclusively for the purpose of the sale of another vehicle of the same class. Some LMCTs have incorrectly obtained a duty exemption for motor vehicles registered and/or used as service demonstrator or service loan vehicles. Motor vehicles, such as those used for a range of business or private purposes, including customer loans, service, workshop and deliveries, promotion and use by directors, employees and their family members are not exempt from duty."
