21.01.2022 Spent some time today watching "Untying the knot" a tv show about a divorce mediator. Of course it is American not Australian so the underpinning law is different. However it is still an interesting show. Mediation definitely offers a cost effective solution instead of taking the divorce to court

15.01.2022 Did you know that only 3% of ALL Family Court matters go to trial? The vast majority are mediated out. Sometimes the parties simply can't afford to continue, with spiralling costs of legal fees. It makes sense to keep the money in YOUR pocket. Mediation is a cost-effective strategy to conclude the matter and keep the cash in the pockets of the 2 parties, not the lawyers :)

10.01.2022 Being Heard in Court The court system does not allow people in conflict to speak for themselves. In mediation, everyone involved has an opportunity to offer his or her perspective on the dispute. The mediator encourages each party to do his or her own talking, in narrative form, and to describe their version of the dispute in their own words. By contrast, in a courtroom the story is told by lawyers, who communicate primarily by putting forward affidavits and annexures. Partie...s are limited as to what they can and cannot say by the nature of the lawyers inquiries and they are further restricted by the rules of evidence and other courtroom protocols. There is not discuss between parties in a courtroom.This robs the parties of a true opportunity to tell their version of the conflict and to share their perspective with the other side in the dispute. It is basic human nature to want to feel understood. People can accomplish this only if they have an actual chance to speak and be heard. The courtroom does not allow for this kind of communication. Mediation, on the other hand, is the ideal environment for creating and promoting understanding. See more

04.01.2022 Mediation is far more cost effective than litigation because it offers both a streamlined way to resolve legal conflicts, and because all parties involved share the cost of one mediator rather than pay individual lawyers to handle their claims. Rather than have a legal case drag on for several months or even years, and incur tens of thousands of dollars in legal fees, a mediated dispute can usually be resolved in anywhere from one to ten sessions, depending on the complexity of the case. More importantly, no matter which mediation strategy you go with online, DIY or in-person mediation will allow you to resolve and finally settle your dispute in a manner that will save you a great deal of emotional heartache and stress.

01.01.2022 This week I attended a Mediation Masterclass at the Supreme Court. I will try to share some of the really interesting info I learned. Prof Jill Howieson talked about how Mentalising is a crucial component of a successful mediation. Unless a party is willing to consider the viewpoint of the other party, there is little chance of mediation. Our role, in part, is to help facilitate that quantum change to allow the parties to consider each other
