19.01.2022 Rejection of certain ‘business interruption’ insurance claims have been unlawful, NSW Supreme Court of Appeal finds. This result means that thousands of businesses who have had their claims for business interruption due to the COVID-19 pandemic rejected, may actually be entitled to cover. Berrill & Watson principal John Berrill said the judgement was a "win" for thousands of small- and medium-sized businesses that have lost income as a result of lockdown restrictions this yea...r. 12.01.2022 If you’re on the Disability Support Pension or don’t have to look for work as part of JobSeeker, you might have a disability which qualifies you to claim insurance benefits in your super. This could be TPD benefits or income protection. It doesn’t matter if you stopped work a long time ago. You could still be eligible.... A TPD lump sum usually won’t affect your Centrelink benefits. Any income protection will count towards your Centrelink income test with the first $174 per fortnight exempt and then reducing your benefit by 50 cents in each dollar. 10.01.2022 MySuper reforms came into effect in 2013 and were designed to protect super accounts of workers who had not selected a super fund but instead been defaulted to the fund choice of their employer. Under MySuper, all super funds are required to establish investment products which comply with a number of minimum requirements. Many people stop working each year because of mental health issues or illness; either permanently or temporarily. Many of them would be entitled to claim income protection or total and permanent disability insurance benefits which are held in their superannuation account.... Mental health issues or illness can take a number of forms and have a number of different causes. For a superannuation or insurance claim, what particular mental illness is diagnosed is not as important as whether or not your illness means you cannot work, either temporarily or permanently. 03.01.2022 TPD claims after a workplace injury If you have workplace injury which requires time off work and/or medical treatment, you’ll likely be entitled to workers compensation under either your state-based scheme or the federal Comcare scheme. If that injury also means you have to stop working, you may also be entitled to TPD benefits through your super.... In most cases, TPD benefits can be paid in addition to your workers compensation benefits. But beware, accessing the TPD lump sum benefits can, under certain circumstances, impact on your workers comp benefits. We need to be sensible about how we operate to avoid taking up hospital beds because hospital beds should be for the more vulnerable in society. This means a significant amount of our staff are working from home but they are fully connected the same as if they would be if they were in the office....
