17.01.2022 Case Study: 17 Avoca St, Heidelberg When council support an application but apply conditions requiring unreasonable change. Application to demolish the existing house and develop two on the site, lodged in July 2013. The application also required the removal of four trees from the site in a vegetation protection area of Banyule Council.... An arborist was appointed by the client, worked with CS Town Planning and the Council arborist to get a design that Banyule Council would support. On the resolution of the tree issues the application was advertised and received an objection from the neighbour. Council ultimately approved the development in December 2013 but place a condition on the approval requiring the deletion of two bedrooms from one of the houses. Given the number of compromises our client had to make on account of the vegetation protection overlay they decided to appeal the condition at VCAT. In April 2014 VCAT heard the case and decided to delete the condition from the permit. Construction on the project commenced in September 2015 and it was completed in September 2016. 15.01.2022 Case Study: 16 Fulton Crescent, Burwood When you need to work with Council to ensure a positive outcome, despite some major barriers like multiple objections. This proposal of three double storey townhouses was approved by Whitehorse City Council in August 2013, with construction completed in July 2017. ... Each house contained three bedrooms with walk in ensuites and a double garage. The application received a number of objections from the neighbours largely relating to car parking, neighbourhood character and increased density issues. The CS Town Planning team met with the objectors at a meeting organised by council to discuss the issues and attempt to resolve some of the concerns. As with most planning applications, we could not agree to all of the requests put forward by the neighbours. We were however, able to work with the Whitehorse council planning team to provide a development outcome that was acceptable to the neighbours and thus avoid a lengthy VCAT delay. Planning can be stressful when you are faced with objectors. It pays to have a team that is skilled at being objective, diplomatic and experienced at getting the best outcome for their clients.
