The principal should appoint an independent third party to fill this role and not one of its own employees. While technically not a requirement for all contracts, engaging a third party reduces the risk of actual or apparent conflict between the employee's duties to their employer and the requirements of the superintendent to carry out certif...ication functions in an independent manner. In addition, case law suggests that under certain contractual arrangements the principal acting as superintendent is prohibited. The case law continues to endorse the independent third party Superintendent for Construction Contracts.
