Y...ou also have non-monetary entitlements that can’t be excluded by a salary like getting pay slips and the right to request flexible working arrangements. Your boss needs to keep track of when you’re working and regularly audit your salary to make sure that you’ve been paid correctly. Specific rules can also apply under your award or agreement, including requirements about record keeping and reconciliation. 20.01.2022 Some changes have been made to the Australian Government Parental Leave Pay scheme. From 1 July, eligible employees can split their parental leave pay over 2 pe...riods. The first parental leave pay period is a continuous period of up to 12 weeks, accessed within 12 months of the childs birth or adoption. The new flexible period allows employees to access another 6 weeks (or 30 days) of parental leave pay flexibly over the first two years after the childs birth or adoption. That includes all time spent: completing compulsory online training... at home starting early or finishing late (at your employer’s request) attending compulsory work meetings out of your normal work hours doing on-the-job training. This might include meeting with them to discuss why you need to cancel your leave, what their concerns are about the cancellation, and any alternative mutually acceptable outcomes, like deferring your leave to later or taking a smaller amount of leave. Sham contracting is where a person ...working as an employee is told theyre a contractor when theyre not. They can also be treated like a contractor in some ways. Sometimes this is done to avoid paying the legal entitlements that would be due if the person was an employee. Sham contracting is illegal. Its illegal to claim an employee is a contractor, say something false to convince them to become a contractor, dismiss or threaten to dismiss them if they dont become a contractor, and dismiss then rehire them as a contractor to do the same work. The Fair Work Act provides serious penalties for businesses or people that contravene these sham contracting prohibitions.
