Former Olympic swimming champion Grant Hackett is allegedly suing his former lawyers for a defective pre-nuptial (financial) agreement with his estranged wife Candice Alley. Whilst we cannot comment on the case, it raises the issue of the importance of ensuring financial agreements made under the Family Law Act meet all the criteria necessary to make them legally binding. If you decide to finalise your property matters with your ex-spouse or partner through a financial agreement under the Act, you must receive independent legal advice, preferably from a family lawyer.

Interesting article by ex-Queensland premier Peter Beattie in today's Australian points to the age old dilemma that justice delayed is justice denied when the courts take too long to decide matters. In family law our hard working judges, magistrates and registrars are too often burdened by needless litigation, resulting in workloads that would make Santa sigh with resignation. Parties in family law matters and their lawyer...s should make negotiated agreements their focus, rather than racing off to court just because negotiations get difficult. Of course that might mean not getting the perfect outcome but that goes both ways and an acceptable settlement in a few months is far better than two years in court, especially for children caught between their warring parents. The recent case involving the Italian father, Australian mother and their four daughters was significantly fought in the media, exposing sensitive family issues to the ruthless public gaze. The public does have a right to know but should that be at the expense of privacy in such difficult circumstances. These syndromes are difficult to prove in the family law context and the courts often put a child's deteriorating behaviour simply down to the effects of the break up, whereas the truth may be more sinister; the child may well be a an abuse victim of one, or both, parents.
