20.01.2022 Unless something changes, reductions in hours under JobKeeper are due to expire at the end of September. So what happens if your boss wants to make the change p...ermanent? You need to be consulted first. The rules around making a permanent change to your hours depend on whether you agree to the change. If it's a permanent change, your full-time employment ends, and you need to enter into a new contract with your employer setting out your agreed weekly hours. This also means the normal rules for ending employment apply, including being given notice and being paid out any accrued entitlements. If you agree to permanently reduce your hours, any award or enterprise agreement rules about recording your new hours in writing and rostering part-time hours apply. You may also be entitled to overtime pay if you work more than your new (reduced) hours. If you dont agree to the change, there are a few factors to consider including: - whether your employment contract, enterprise agreement or award lets your employer change your hours without your agreement - whether the change ends your full-time employment and makes a new part-time employment contract - what entitlements need to be paid out to you - how much notice you need to be given. Generally, you can't be forced to reduce your hours without your employer ending your full-time position and re-engaging you as a part time employee. If they do this, the usual protections from unfair and unlawful termination apply. Your full-time role shouldnt be terminated for a discriminatory reason, because you exercised a workplace right or for another reason protected by law. Different payment types are... reported differently: JobKeeper payments if youre an employee these will be included on your income statement as salary and wages or an allowance. JobSeeker payments need to be included in your tax return and will also be included on your Centrelink payment summary. Accessed super you dont need to pay tax on COVID-19 early release of super amounts, so you dont need to include this in your tax return. No need to manually fill this out, most info will be automatically included in your tax return by late July. 08.01.2022 If your boss is no longer participating in JobKeeper, but they’ve still had a decline in turnover, they could be regarded as a ‘legacy’ employer. Legacy employe...rs can still give you some JobKeeper directions, such as reducing your hours, as long as you were previously eligible for JobKeeper. To give these kinds of directions, they must follow other conditions too. If your boss is a legacy employer and has any existing JobKeeper directions with you, they will end on 27 September 2020. Any new JobKeeper direction made by your boss to reduce your hours of work must: leave part-time and full-time employees with at least 60% of your ordinary hours as at 1 March 2020 (although sometimes a different way of working out these hours can apply), and result in you working for 2 hours or more on a workday.
