22.01.2022 There was an article in the Cairns Post on the weekend recommending that buyers offer a large deposit, such as 12% or 15%, when offering to purchase a property as an incentive for the seller to accept your offer. This is NOT something you should do and if you are a seller you should NOT sign a contract with a deposit of greater than 10%. In Queensland, the deposit can be any amount up to a maximum of 10% of the purchase price. If the deposit is greater than 10%, the contra...ct becomes an "instalment contract" which has serious implications, especially for a seller. For example, the buyer has a legal right to lodge a caveat on the title, the seller cannot mortgage the property and the buyer can demand the transfer of the property into the name of the buyer before all of the purchase price has been paid. If you are a buyer about to make an offer on a property or a seller about to sign a contract, we are happy to review the contract before it is signed to make sure there are no hidden pitfalls.

21.01.2022 BUSINESS CONTINUITY PLANS How well would your business cope with a disaster or even a small change in routine? Do you have a checklist of procedures for your staff to follow? Prepare a business continuity plan now so that you are prepared for any event, large or small, in the future. It can be as simple as procedures to follow if office keys are lost, or email is inaccessible, or eftpos is unavailable, or if there is a temporary power outage, right through to procedures to follow when dealing with a major disaster.

21.01.2022 Without Prejudice? You might have seen legal letters with the words "without prejudice" written on the top. But what does does mean? Communications can be made on a "without prejudice" basis where the parties are negotiating the settlement of a dispute, such as payment of a debt. By making a statement or an offer on a "without prejudice" basis, the parties can negotiate a settlement or offer a compromise knowing that their statements will not later be used in court as an admission of liability.

16.01.2022 HOMEBUILDER SCHEME - NEW BUILDS AND RENOS Some details were released today about the new Commonwealth HomeBuilder grant scheme . The $25,000 grant will be available for building contracts signed between 4 June 2020 and 31 December 2020. The grant is available for new home construction or substantial renovations. To be eligible an applicant need not be a first home owner.... There is also an income cap of $125,000 pa for single applicants or $200,000 for couples. The total value of the land and the new building cannot exceed $750,000.00 and the home must be used as the principal place of residence. For renovations, the valuation of the renovation contract must be between $150,000 and $750,000 and the value of the house and land must not exceed $1.5m. The grant is only available where the renovation will improve the accessibility, liveability and safety of the property i.e. not for a pool, tennis court, shed etc. The HomeBuilder grant can be used in addition to State and Territory first home owner grant programs, stamp duty concessions and other grant schemes, as well as the Commonwealths first home loan deposit scheme and first home super saver scheme. Further information about how and when to apply will be available through the Qld State Government soon. The amount of funds provided by the Commonwealth Government at this stage means that approximately 27,000 grants for home construction and major renovations will be available Australia wide so it would be wise to apply quickly if you are eligible.

12.01.2022 What Happens if you Die Without A Will? If a person dies without a Will, the process of administering the estate may take longer and be more costly than if the person died leaving a valid Will. Legally, the estate is called an "intestacy". Uusually it is necessary for a relative or beneficiary to apply to the Court for "Letters of Administration" where they are appointed as the administrator of the estate. This person will then have much the same duties as an executor appo...inted under a Will. The law states how the estate of the deceased person is to be distributed. In Queensland, after the debts of the deceased are paid, the law states that: - if there are no children, the spouse receives all of the estate; - if there is one child, the spouse receives the household goods and the first $150,000 and the balance is divided equally between the child and the spouse; - if there is more than one child, the spouse receives the household goods, the first $150,000 and one third of the balance, and the children share the remaining two thirds of the balance; - if no spouse or children survive, parents or other close relatives will inherit the estate. If this is NOT what you want to happen to your assets when you die, make sure you have a valid Will. And, most importantly, remember to make a new one if your circumstances change (e.g. if you marry or divorce).

07.01.2022 If you are signing a contract to purchase a property, make sure that you pay the deposit by the due date. If you pay late, this is a breach of the contract which may entitle the seller to terminate at any time. Also, if the deposit was paid late, if you terminate the contract due to lack of finance or unsatisfactory building and pest inspections, you might not get your deposit back. A lot of contracts say the deposit is due on the date the buyer signs it. Ask the agent to change the contract before you sign it so that the deposit is due 2 or 3 business days after the date of the contract so that you can have plenty of time to pay the deposit.

02.01.2022 If you are a first home owner and you are buying a brand new house in Queensland, or buying land in Queensland to build your first home, you could be eligble for the First Home Owners Grant of $20,000.00. You must be an Australian citizen or permanent resident, you and your spouse must not have previously owned residential property in Qld, and you must move into the property as your home and live in it for 12 months If this sounds like you, there are some other conditions so check out your eligibility.
