23.01.2022 Divorce is the formal legal ending of a marriage. At Souki Lawyers, we understand the difficulties individuals experience when experiencing the breakdown of a relationship. Our approach is one centred on transparency in legal process, together with empathy and understanding. Our aim is to ensure that the already difficult road ahead is somewhat clearer. ... A divorce application is made in the Federal Circuit Court of Australia who has jurisdiction to deal with the dissolution of marriage pursuant to Part VI of the Family Law Act 1975. If you are in Western Australia, you will need to apply to the Family Court of Western Australia. In Australia, the law does not consider whose fault it is that the marriage broke down. However, the Court must be satisfied: 1. A marriage existed; 2. The parties are ordinarily domiciled in Australia; 3. The parties have separated for a period of 12 months; and 4. The marriage has broken down irretrievably. Whilst a divorce order will not include parenting or property arrangements, if you have children under the age of 18, the Court must consider whether the parties have made proper arrangements for their care, development and welfare. If granted, a Divorce Order will take effect following one month and one day from the date of Order. You will not be able to re-marry until the divorce order is finalised. 19.01.2022 Souki Lawyers recently achieved a great outcome for a client in the Fair Work Commission for an unfair dismissal claim . We negotiated and settled the matter on the basis our client is paid an equivalent of 5 months worth of wages because reinstatement was not the appropriate remedy. This being a great outcome in an unfair dismissal claim as the maximum compensation the Commission can award an employee is 6 months of their ordinary pay. 06.01.2022 Respondents to an Intervention Order will often consent without admission to the Order with a view to finalise the matter. In Victoria under Section 3 of the Firearms Act 1996 (the 'Act'), you will be deemed a prohibited person if you are subject to a Final Intervention Order. Being deemed a prohibited person means that you will not be able to possess a firearms licence for the duration of the Order and for five years following its expiry.... You may be able to apply to the Court to be deemed a non-prohibited person under Section 189 of the Act. Should the application be successful, your firearms licence will be reinstated if it has been suspended or alternatively you will have the liberty to apply for a new licence if it has been cancelled.
